Attorneys increasingly rely on the services of mental health practitioners. Although some practitioners lack training, the promise of professional rewards lead some to accept opportunities with resulting ethical quandaries. Due to significant differences between the objectives of traditional mental health services and expert testimony, problems occur when clinicians venture into forensic services. Attorneys and judges, unfamiliar with mental health specialties, may seek to press a mental health practitioner into multiple roles. Although not all multiple roles are ethically inappropriate, caution demands (...) careful parsing of particular roles: (a) academic/behavioral science expert; (b) fact witness as a treating therapist; (c) expert witness based on a clinically oriented assessment; (d) pretrial and/or trial consultant; and (e) professional critic of other experts. Possible ethical issues and risks associated with accepting multiple roles are identified and strategies for avoiding or minimizing harm or exploitation are discussed. (shrink)

Among mainstream political philosophers, Charles Mills is probably best known, not as the author of The Racial Contract, but for his long-running critique of ideal theory and Rawls for his association with it. Yet the critique of ideal theory that followed the publication of The Racial Contract is prefigured in that very work, where we find in inchoate form what would be further developed later on. In the book, this early formulation of the critique occupies a small part of a (...) larger, more general argument condemning mainstream political philosophy for the way that it has ignored race. In this paper, I explore the relation of the critique to this more general argument. It might be thought that the general argument leads inevitably to the critique of ideal theory. I will argue that this is not so. I will show how Mills’ more general argument can be made without taking the further step of critiquing ideal theorizing. The blame for why mainstream political philosophy has ignored race, and continues to ignore race, I will argue, should be placed elsewhere. (shrink)

Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...) Indigenous communities, individuals with certain disabilities, and low-income persons. However, many health systems have resorted to first-come, first-served approaches to allocation, which tend to disadvantage individuals with barriers in access to care (3). There is mounting evidence of racial, ethnic, and socioeconomic disparities in access to medications for COVID-19 (4, 5). -/- One potential method to promote equitable allocation is to use a weighted lottery, which is an allocation strategy that gives all eligible patients a chance to receive the scarce treatment while also allowing the assignment of higher or lower chances according to other ethical considerations (6). We sought to assess the feasibility of implementing a weighted lottery to allocate scarce COVID-19 medications in a large U.S. health system and to determine whether the weighted lottery promotes equitable allocation. D.C. Schindler reminds us that the motto of Villanova consists of three terms: Unitas, Caritas and Veritas. Postmodern philosophy is keen to malign good Veritas as an exercise in oppression, something which must be avoided if we truly want to reach universal care and unity. In opposition to this trend, Schindler illustrates how Desmond’s philosophy is capable of giving truth its dues against the assaults of Vattimo and others, but also and more importantly that truth serves as foundational for unity (...) and care. This intervention queries whether subjecting feminist jurisprudence to a methodological transfiguration toward pragrammatology (Derrida, in Smith and Kerrigan 1984) holds liberating potential for f (be it ‘woman’, ‘female’ or ‘feminine’) as both a signifier and a subject to be read with lucidity and nuance in feminist justice claims. I examine feminist jurisprudence’s methodological challenges in the settler colonial context of Alaska with respect to the murders of Della Brown (in 2000) and Mindy Schloss (in 2007). I advance my case for (...) pragrammatology as a critical methodology for feminist jurisprudence by subjecting the case(s) of Brown and Schloss to a more lucid (re)reading in two related and intersecting moves. First, I trace and deconstruct the citations of Brown and Schloss’ legal narratives to expose violence in the systemisation of f as a power and legal relation (Ahmed in Soc Legal Stud 4:55–73, 1995). I then examine the paradoxical nature of f justice claims which necessitate a pragrammatological approach. I conclude by advancing counsel on how we might move within paradox. (shrink)

The use of virtual fencing in pasture-grazed farm systems is currently close to commercial reality but there are no studies applying the principles of responsible research and innovation, such as foresighting, to this technology. This paper reports results of a study aimed at foresighting potential implications associated with virtual fencing of cattle. A Delphi method was used to survey the opinions of farming practitioners and researchers, using pasture-grazed cattle farming in New Zealand as a case study. The key benefits were (...) identified as environmental protection, improved feed allocation, access to previously unavailable grazing areas, labour savings and individual animal management. The five most important potential barriers identified were device reliability, farmer perception of a value proposition, ethical issues related to community perception of negative animal welfare, lack of feed budgeting skills of farmers, and excessive training time. We suggest that more knowledge is needed on ethical issues associated with VF, including understanding public opinions of such technology developments. We suggest that development and use of VF has been focussed primarily on technical features and user benefits and needs to include consideration of wider socio-ethical principles to ensure responsible innovation processes. The findings from this study will aid focussed research and development to incorporate ethically acceptable development alongside technical factors. (shrink)

In this thesis I shall summarize and critically examine the central features of the theories of values of four contemporary moral philosophers: A.J. Ayer, C.L. Stevenson, R.M. Hare, and P.H. Nowell - Smith. I shall first look back, however, to the theory of moral philosophy of the most influential 'forefather' of this group, David Hume. Hume's theory stands as a challenge to moral philosophers who would assume that moral judgments are primarily, in some sense, acts of 'reason'. In his much-explored argument for the tripartition of the soul in book IV of the Republic, Socrates makes use of two principles, which I shall call the principle of opposition and the principle of qualification. The aim of the present paper is to explain, in particular, the second of these principles, so as to reveal its role in that argument and in the conception of an appetite and of the appetitive part that is central to the larger argument of the (...) Republic as a whole. Section 1 briefly introduces the principle of opposition, analyzes the principle of qualification, and presents the argument for tripartition. Section 2 uses the analysis of the principle of qualification to interpret a claim Socrates makes about the soul and its relation to the good, which seems at odds with the account of appetites uncovered in Sect. 1. Then, in Sect. 3, the relevance of the principle of qualification to Socratic intellectualism—the view that knowledge is sufficient for virtue—is explored. In Sect. 4, appetites are returned to with the focus now on the varieties of them that Socrates recognizes. In Sect. 5, a view is put forward about the nature of the appetitive part (Appetite), its beliefs, and its ability to be persuaded by the rational part (Reason). In Sect. 6, it is argued that Appetite and Reason are both souls, capable of working in harmony, but also of being opposed, thereby underwriting an important part of the analogy between the polis and the soul on which much of the Republic relies. Cognitive neuroenhancement involves the use of medical interventions to improve normal cognitive functioning such as memory, focus, concentration, or willpower. In this paper I give a Kantian argument defending the use of CNE in science, scholarly research, and creative fields. Kant’s universal law formulation of the categorical imperative shows why enhancement is morally wrong in the familiar contexts of sports or competitive games. This argument, however, does not apply to the use of CNE in higher education, scholarly or scientific research, (...) or creative endeavors such as visual art, fiction or poetry, or musical composition. This is because performance in these areas is embedded within practices that differ in morally significant ways from competitive practices. This important difference provides good reason to think that there is nothing morally wrong with the use of CNE in these areas. My approach is not simply to assume a full-fledged Kantian ethical theory and apply it straight away to the enhancement issue but to establish a reflective equilibrium between our moral intuitions, moral principles that support those intuitions, and the nature of the practices involved. This book explores 'nothingness', the negative way found in Buddhist and Christian traditions, with a focused and comparative approach. It examines the works of Nagarjuna (c. 150 CE), a Buddhist monk, philosopher and one of the greatest thinkers of classical India, and those of John of the Cross (1542-1591), a Carmelite monk, outstanding Spanish poet, and one of the greatest mystical theologians. The conception of nothingness in both the thinkers points to a paradox of linguistic transcendence and provides a novel (...) insight into via negativa. This is the first full-length work comparing nothingness (emptiness) in Nagarjuna (Mahayana Buddhism) and John of the Cross (Christianity) in any language. It augments the comparative approach found in Buddhist-Christian comparative philosophy and theology. I examine the status of Aristotle’s science of soul and argue that it is trans-generic in the way that Aristotle's universal mathematics is. For just as the branches of the latter differ considerably, so too do the sciences of life: botany, zoology, psychology, and (in Aristotle’s view) astronomy and theology. Discovering the correct definition of soul, which is their starting point or first principle, as with other scientific starting points, involves both induction and dialectic. Induction uses scientific observation of living (...) things to move toward this starting point. Dialectic enables the scientist to assemble endoxa, or reputable beliefs, that allow us to solve each puzzle (aporia) that clouds our understanding (nous) of the starting point that induction enables us to reach. Some of the methods for data collection in experimental psychology, as well as many of the inferences from observed behavior or image scanning, are based on the implicit premise that language use can be linked, via the meaning of words, to specific subjective states. Wittgenstein’s well known private language argument (PLA), however, calls into question the legitimacy of such inferences. According to a strong interpretation of PLA, all of the elements of a language must be publicly available. Thus the meaning (...) of words is not fixed by reference to our private experiences, and so data from subjective state claims indicates nothing about our subjective experiences. Application of PLA to psychological studies based on descriptions of the experience of orgasm offers support for the strong version of the conclusion of PLA. We show that PLA has deep implications for data collection methods and inferences in experimental psychology. In particular we critique two contemporary research projects in neuroscience: one studying the ability to remember emotionally loaded words and the other studying experience of attraction. Both of these projects attempt to link subjective experiences and thought processes to particular observable brain states. The research methods appeal to (implicit) inferences from linguistic usage to subjective states. Application of PLA will show that such inferences cannot be made because the meaning of a word is not determined by any subjective state of the speaker. (shrink)

This paper examines the realist interpretation of Vedānta that Rasvihari Das explicated in two of his celebrated treatises, namely, “The Theory of Ignorance in Advaitism” and “The Falsity of the World.” Rasvihari Das, unlike many of his contemporary thinkers of India, took a contrary position against the uninformed generalization about Indian thought that the philosophical tradition of India was one of an unbroken idealism and spiritualism. Though Rasviahari Das was influenced by his senior peer-thinkers of India like Hiralal Haldar, B. (...) N. Seal, and K. C. Bhattacharyya, Rasvihari Das had his own independent view on and interpretation of Vedānta. The paper argues that in the Vedāntic realism of Rasvihari Das there is no rejection of the world or the individuals. In the first part of the paper, I suggests the possible influence of Indian realism on Rasvihari Das. In the second part, I make an attempt to unearth and examine the interpretation of Rasvihari Das that unravels his Vedāntic realism. The third part is the concluding appraisal of Rasvihari Das who could take Vedānta forward from its religious moorings and place it resolutely on a philosophical candour. (shrink)
